Western Imperial Magnetics Ltd. - Terms of Service

Last updated: October 2026

1. Overview

This website,  Western Media Source, is operated by Western Imperial Magnetics Ltd. Throughout these Terms of Service, "Western Media Source," "we," "us" and "our" refer to Western Imperial Magnetics Ltd.

These Terms govern your use of our website and purchases of our products and services, including data storage solutions, recording media, media packaging, related equipment and accessories, duplication, graphic design and custom printing.

Please read these Terms before using the website or placing an order. By using the website or placing an order, you agree to these Terms, subject to applicable law and any separate written agreement with us. If you do not agree, do not use the website or place an order.

Nothing in these Terms limits consumer rights, warranties or remedies that cannot lawfully be excluded or restricted.

2. Eligibility and Business Purchases

You must be legally capable of entering into a binding agreement to place an order. If you act for a company or other organization, you confirm that you have authority to bind it and authorize the purchase.

You agree to use the website, products and services lawfully and to comply with applicable intellectual property, privacy and other legal requirements.

3. Customer Accounts and Information

You must provide accurate and complete contact, billing, shipping and account information and promptly update information that changes.

Where a customer account is available, you are responsible for safeguarding its credentials and controlling authorized access. Contact us promptly if you suspect unauthorized use. We may verify order or account details where reasonably necessary to prevent fraud or complete a transaction.

4. Product Information and Availability

We aim to keep product descriptions, specifications, prices and availability accurate. However, errors and changes may occur. Product images are illustrative, and packaging or appearance may vary.

Check the specifications and compatibility requirements relevant to your intended use. If you need a particular interface, capacity, format or performance standard, contact us before ordering.

We may change our catalogue, limit available quantities or discontinue products. These changes do not remove our obligations under an accepted order or applicable law. We will not substitute a materially different product without your agreement.

5. Pricing, Quotations and Payment

Prices are in Canadian dollars unless expressly stated otherwise. Applicable taxes, shipping charges and other disclosed fees are added to the purchase price as shown at checkout or in an agreed quotation.

Prices may change before an order is accepted. Written quotations for in stock merchandise are valid for the period of 10 calendar days or as otherwise stated in the quotation and cover only the products, quantities and services identified. Pricing for special order items is not guaranteed due to market changes, currency fluctuations, vendor pricing increases or acts of God.

Payment is due according to the terms shown at checkout or agreed in writing. Credit terms, deposits and staged payments apply only where expressly agreed. You confirm that you are authorized to use the payment method supplied.

If we identify a material pricing or description error affecting your order, we will contact you to explain the issue and any available options. We will not charge an increased price without your agreement. If the order is lawfully cancelled, amounts paid for the cancelled items will be refunded as required by law.

6. Orders and Acceptance

Submitting an order is a request to purchase. An automated acknowledgement confirms receipt and does not, itself, confirm acceptance. We accept an order when we expressly confirm acceptance or dispatch the goods, whichever occurs first. For service projects, acceptance occurs when we confirm the project in writing.

Before acceptance, we may decline an order for lawful reasons, including unavailable stock, an unresolved material error, delivery restrictions or suspected fraud. We will notify you and refund any payment taken for an order we decline.

Accepted orders may be changed or cancelled if prompt notification is given and by agreement or as permitted by applicable law. Contact us promptly if you wish to make a change.

7. Shipping and Delivery

Shipping arrangements are described in our Shipping and Returns and any terms agreed for your order.

Unless otherwise advised, standard orders are normally dispatched within two business days after payment is received; special orders may take longer. Transit estimates vary by destination and are not guaranteed delivery dates unless expressly agreed.

Provide a complete, accurate delivery address. We will advise you of additional delivery charges requiring your agreement. We do not fulfill order shipments outside Canada unless specially arranged.

Please inspect deliveries promptly upon receipt and report any shortages, incorrect items or damage to us immediately. Failure to do so may affect our ability to replace or return certain items. Preserve all packaging and take photographs where possible so we can assist with a carrier claim if applicable. These reporting requests do not reduce any mandatory legal rights or remedies.

8. Returns, Cancellations and Refunds

Our Shipping and Returns sets out the conditions for voluntary returns. Unless otherwise stated, eligible goods may be returned within 90 calendar days with a Return Merchandise Authorization (RMA). Goods must be factory sealed, in new and resaleable condition, and adequately packaged to mitigate any damage that may occur in transport back to us.

A 15% restocking fee applies to eligible voluntary returns. Clearance and special-order items are excluded from voluntary returns. Contact sales@wimmedia.com or call 1-800-663-8273, option 1, to request an RMA before returning goods.

These conditions do not override rights relating to defective or misdescribed goods, statutory cancellation rights, or other mandatory remedies. Where the law requires a full refund without deductions, no restocking fee will apply. In a conflict between these Terms and the linked policy, applicable law takes priority, followed by the consumer-rights protections in these Terms.

9. Custom Printing, Design and Duplication

The scope, specifications, deliverables, price and schedule for custom work will be set out in the agreed quotation or project confirmation.

You are responsible for providing suitable source files and accurate instructions, and for holding the permissions needed to reproduce, modify or use any submitted text, images, recordings, logos or other materials. For any reproduction of a client’s content, an IPR (Intellectual Property Rights) form will be required (available upon request).

Where we provide a proof, you must review it carefully, including spelling, layout, quantities and specifications, and provide the requested approval before production. Changes requested after approval may affect price and timing; and additional charges that require your agreement may apply. Screen displays may differ from printed colours, so discuss any precise colour requirements with our graphics designer before approving production proofs or related projects components.

Keep backup copies of files you submit. Unless expressly included in the agreed scope, our services do not include ongoing file storage, archival backup or data recovery.

Cancellation charges, revision allowances and ownership of newly created design work must be specified in the project agreement. These Terms do not introduce an undisclosed cancellation fee or transfer ownership of your original materials.

10. Customer Materials and Feedback

You retain your rights in materials you provide. You grant us a limited permission to copy (accompanied by an Intellectual Property Rights form as forementioned), process, adapt and share those materials with relevant service providers only as needed to fulfil your instructions, complete the agreed services or comply with law.

This permission does not authorize us to publish confidential project files or use them in marketing. Any such use requires separate permission from the IPR owner.

You may provide suggestions or feedback about our business. We may use general feedback to improve our services, but will not publish your name, testimonial or confidential information without written and/or appropriate permission.

11. Website Intellectual Property

Website text, graphics, branding, layouts and other content are owned by us or used with permission, except where otherwise identified. Manufacturer names and trademarks belong to their respective owners.

You may view and use website content to evaluate and purchase our products or services. You may not copy, republish or commercially exploit protected content without authorization, except as permitted by law.

12. Prohibited Conduct

You must not:

  • Use the website for fraud, unlawful transactions or infringement of another person's rights.
  • Submit misleading information or impersonate another person or organization.
  • Upload malware or attempt unauthorized access to accounts, systems or data.
  • Interfere with website security or availability.
  • Collect personal information about others without lawful authority.
  • Harass or threaten staff or other users (such behavior will result in refusal of service)
  • Submit materials you are not authorized to reproduce or distribute.

We may restrict website or account access where reasonably necessary to address a breach or protect systems and users, subject to applicable law and existing contractual obligations.

13. Third-Party Tools and Links

The website may link to manufacturer resources, software, payment services or other third-party tools and websites. Independent third-party services may have their own terms and privacy policies.

We do not control independent third-party websites, guarantee their content nor availability nor accept any 3rd party responsibility for their content. This section does not exclude our responsibilities for products or services we sell to you or for providers acting on our behalf where the law makes us responsible.

14. Personal Information

Our collection, use and disclosure of personal information are described in our Privacy Policy:

Privacy Policy - Western Imperial Magnetics Ltd.

Please review that policy before submitting personal information. Do not submit unnecessary sensitive information in enquiries or project files.

15. Warranties and Website Availability

Manufacturer warranties may apply to particular products. Coverage, eligibility and claim procedures depend on the relevant warranty terms for each product. Contact us for assistance with a defective item or warranty enquiry.

Express commitments in an accepted quotation or written agreement remain applicable. Manufacturer warranty procedures do not replace rights or remedies you have against us under applicable law.

We take reasonable steps to maintain the website but cannot guarantee uninterrupted or error-free access. To the extent permitted by law, website access and general informational tools are provided on an "as available" basis without additional warranties. This website disclaimer does not remove product or service warranties that apply by law or express agreement.

16. Limitation of Liability

To the extent permitted by applicable law, we are not liable for indirect or consequential losses arising from use of the website or the products or services we supply, including indirect loss of profit, business opportunity or data.

This limitation does not exclude liability for fraud, willful misconduct, or any liability that cannot lawfully be excluded. It does not restrict mandatory consumer rights or remedies. Any additional liability limits for a business project must be expressly agreed in writing.

You should maintain suitable backups of important data and follow relevant manufacturer instructions. This responsibility does not relieve us of obligations imposed by law or an express agreement.

17. Indemnity for Business Customers

If you purchase for a business, and to the extent permitted by law, you agree to indemnify us against reasonable losses and legal costs arising from a third-party claim that materials you supplied for reproduction infringe that third party's intellectual property rights, to the extent caused by your failure to obtain the required permission.

This obligation does not apply to losses caused by our negligence, misconduct or unauthorized use or alteration of your materials. We will promptly notify you of a relevant claim and reasonably cooperate in its defense. No settlement imposing an obligation or admission on you may be made without your agreement.

18. Suspension and Termination

You may stop using the website at any time. We may suspend or terminate website access for a material breach of these Terms or where reasonably necessary for security or legal compliance.

Stopping or restricting website use does not automatically cancel an accepted order, remove an existing payment obligation or extinguish a refund or other accrued right. Provisions intended to continue after termination remain effective to the extent permitted by law.

19. Governing Law and General Provisions

These Terms are governed by the laws of British Columbia and the applicable federal laws of Canada, subject to any mandatory protections available under the laws that apply to you.

These Terms, applicable policies made available before purchase, and the accepted order or project agreement form the agreement for the relevant transaction. A separately agreed written term takes priority over an inconsistent general term, subject to applicable law.

If a provision is unenforceable, the remaining provisions continue to apply where legally possible. A failure to enforce a provision on one occasion does not waive the right to enforce it later.

20. Changes to These Terms

We may update these Terms by publishing a revised version and changing the date above. Updates apply prospectively and do not change an already accepted order without agreement or lawful authority. We will give additional notice or obtain agreement where required.
